Attorneys Alex and Maximiliano Galindo of Curd, Galindo & Smith LLP have filed a lawsuit against Ghost LLC, the maker of Ghost Energy Drinks, after a California man allegedly discovered a dead baby rat in his can of Ghost Sour Green Apple.
According to court documents filed in Orange County Superior Court (Case No. 30-2025-01490880-CU-PL-CJC), plaintiff Andrew Rios purchased the drink from an Albertsons store in La Habra on June 6, 2025. After consuming the drink, Rios alleges that after he drank his Ghost Sour Apple drink he discovered a dead baby rat inside the can. He was mortified and immediately went to an urgent care and sought medical attention.
The suit claims the product is marketed for energy and performance benefits, and seeks unspecified damages for the incident.
